Use Bankruptcy To Get Back On Your Feet
Coming to the realization that you have no money can be a frightening one. You feel lost and alone and you may think that there is no one out there who can help you deal with the situation. The fact is that there is a great deal of bankruptcy legal help available to people who are faced with serious financial challenges. A good adviser can help you navigate the paperwork you need to complete when declaring that you’re bankrupt and also propose alternative suggestions to help you avoid the process altogether.
If you have been having credit problems for some time, the credit card debt bankruptcy process may seem like the light at the end of the tunnel. You may have been harassed by utility and credit card companies or you may owe a lot of money in income tax. Whatever the reason for your debt if you are at the point of making that final declaration, things may be very grim indeed. However, the process is only the beginning of rebuilding your life and you will still need to make payments to some of your creditors although the amounts will be drastically reduced. Because the payments are lower and often more manageable, this is the reason that so many people choose to go this route.
You need to meet a few criteria before you may be allowed to declare. Usually, the laws surrounding who can declare and who cannot will vary from country to country. There may be different rules from state to state or province to province as well. Usually you must owe more than a set amount (more than $1000 for example), be unable to make your payments and have assets which would not cover your debt even if you were to sell them off.
Did you know that in Canada, for example, a declaration of bankruptcy will actually stay on your credit record for approximately six years? This means that for six years you file, you will find it very difficult to get credit of any kind? This makes sense. After all, if you have done this once as a way to protect yourself from debt repayment, creditors may worry that you will simply repeat the process and they will lose their money.
