The types of credit trouble that people find themselves in can be across the spectrum, from minor past due debts, to huge amounts of money that are overdue, and creditors calling and demanding payment. In some cases, creditors can get threatening, even though this is illegal. Creditors today know that many people are not going to be able to pay, and these creditors use less than ethical ways to get some of the money from the borrowers before they go completely belly up and declare bankruptcy.
Because the process can be truly scary for some people, a question arises whether to hire a credit repair attorney. In some cases, it may seem like hiring a lawyer to help fix things might be a good idea. But the fact is that there are only a few cases where using a lawyer to help you is a good idea. Credit repair attorneys can be quite expensive. they will not work for free, or on contingency, because they have no way to collect. For someone who has little money to begin with,and is facing financial and budget problems, spending more money o lawyers is not a good idea. if you are considering hiring a lawyer to help with credit repair, the truth is that there is much you can do on your own, like sell of some items to pay down debt, start paying your debt on time, or, if you are in a true mess, consider bankruptcy.
A credit repair attorney is going to offer the same services that many free, non profit consumer counseling agencies will offer. They can help you prepare a budget, list your debts and payments, and reach out to your creditors to negotiate a discount or a way to repay over time. It’s only in cases where your total amount of debt is truly high, and your assets also are worth a lot of money, that a lawyer could help. An attorney can help you figure out how to protect some of your assets from creditors, who will come after you by filing suits in court, looking to get a judgment against you, and then seize your assets.
If you have no assets to speak of, you are what is called “judgement proof”. This just means that even if a credit gets a judgement against you, you don’t own any property they can seize, sell and be repaid with. So, unless you are truly wealthy and have assets you need to protect, using a credit repair attorney is probably not worth it, and you could begin to repair credit on your own first.
